Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") govern your use of the When & Where mobile application and related services (the "Service") provided by IronLlama LLC ("IronLlama," "we," "us," or "our"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required by law in your country) to use the Service. By using the Service you represent that you meet this requirement.

3. License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use the Service on devices you own or control, solely for your personal, non-commercial entertainment.

4. Accounts & profiles

You are responsible for activity on your in-game profile. You agree not to share credentials, impersonate others, or use the Service to harass, defraud, or harm others.

5. In-app purchases and virtual items

• The Service may offer in-app purchases ("IAPs") of virtual items, currency, or content. All purchases are processed by Apple App Store or Google Play under their respective terms.
• Virtual items have no monetary value, cannot be redeemed for cash, and are licensed to you (not sold). We may modify, suspend, or remove virtual items at our discretion.
• Refunds are handled by the applicable app store. Except where required by law, IAPs are non-refundable.

6. User conduct

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.
• Use bots, scripts, modified clients, or other unauthorized means to play.
• Interfere with the Service or attempt to access data that is not yours.
• Use the Service to violate any law or third-party rights.

7. Intellectual property

The Service, including all artwork, code, gameplay design, and trademarks, is owned by IronLlama or its licensors and is protected by intellectual property laws. No rights are granted to you except as expressly stated in these Terms.

8. Third-party services

The Service relies on third-party providers (including Apple, Google, and Unity LevelPlay / ironSource ad mediation). We are not responsible for their content, ads, or practices. Your use of third-party services is governed by their respective terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONLLAMA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$25.

11. Indemnification

You agree to indemnify and hold IronLlama harmless from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of [TODO: state of formation], without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in that state, and you consent to the personal jurisdiction of those courts.

14. Changes

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Service after changes take effect constitutes acceptance.
